Terms of use

The Terms and Conditions contain the entirety of the mutual obligations between the "User", the "Member", and TL Hub related to the use of the TL Hub Platform.

As such, TL Hub provides services related to the recruitment process by making available to Users and Members an application platform allowing them to apply for the offers published on it.

1. DEFINITION

1.1. For the purposes of these Terms and Conditions, the following terms shall have the following meanings:

  • "Personal Data" means, with respect to Article 4, 1) of the EU Regulation UE 2016/679 of the 27th of April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), "any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity; »

 

  • "Computer support" means the various media through which the TL Hub Platform can be accessed. This includes smartphones, tablets, internet-enabled PCs or Apple computers, and any object connected/connectable to another object as well as to the internet;

 

  • "User" means any person browsing the TL Hub Platform by means of any computer medium (e.g., visitor). Also means the User who participates in the Account creation process and whose Account has not yet been verified and accepted by TL Hub;

 

  • "Member" : means any person who has an "Account" allowing him/her to apply for the published offers. His or her Account will have been previously verified and accepted by TL Hub as part of the Account creation process described in Article 4 of the General Terms and Conditions;

 

  • "Employer" : means any natural or legal person taking part in the recruitment process in relation to the published offers and to whom the employment decision belongs solely.

 

2. SCOPE OF APPLICATION

2.1. These Terms and Conditions apply to any visit or use of the TL Hub Platform and are intended to set the conditions of access, provision, and use of the Platform as well as its features and content by Users and Members.

2.2. Users and Members acknowledge that by visiting or using the TL Hub Platform, they are aware of these Terms and Conditions and expressly agree to the rights and obligations arising from them.

2.3. TL Hub reserves the right to modify or update these Terms and Conditions at any time without prior notice. We will, however, apply the Terms and Conditions in effect at the time of use or visit of the TL Hub Platform.

2.4. The Dutch version of the Terms and Conditions shall prevail in case of interpretation.

3. PERSONAL DATA

3.1. TL Hub collects Personal Data about Users and Members in the course of their browsing or use of the TL Hub Platform in accordance with its Privacy policy available via the following link: https://www.tl-hub.be/en/page/privacy

3.2. Personal data is collected, processed, recorded, and stored in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data applicable since 25 May 2018. The data processing also complies with the transposition law of July 30, 2018, on the protection of natural persons with regard to the processing of personal data.

4. TL HUB SERVICES

4.1. Apply for Jobs

TL Hub offers among its services the possibility to apply for job offers, anonymous or not (anonymous job offers correspond to offers where the name of the Employer does not appear in the description of the offer), for the Members of its Platform. These job offers are regularly updated and contain information on the profile sought as well as on the position to be filled by the Employer.

4.2. Job Alert – Newsletter – News

4.2.1. Users and Members have the possibility to receive periodically by e-mail new job offers published on the TL Hub Platform by subscribing to the TL Hub Job Alert service.

4.2.2. In this case, they agree to receive regular notifications about new job offers published on the Platform. Users and Members also have the possibility to stay informed about the latest news and trends in the construction employment sector. To do so, they can subscribe by e-mail to the TL Hub Newsletter.

4.2.3. In general, TL Hub, in partnership with other actors of the construction industry or not, will regularly publish on its Platform content including the latest news and important events in the construction sector in particular. This service is accessible to both Users and Members of TL Hub.

4.2.4. Users and Members may unsubscribe from the Job Alert service or the TL Hub Newsletter at any time.

4.3. The TL Hub Account

4.3.1. TL Hub also provides Users with the possibility to create an Account on the Platform allowing them to become a Member and to apply for published job offers.

4.3.2. The TL Hub Account contains personal information relating to the Member's profile, including in particular his professional experience, skills, titles, and diplomas if any, as well as relevant documents justifying his background and qualifications (CV, portfolio, diplomas, etc.).

4.3.3. Some services offered by TL Hub are only available if the Member has a TL Hub Account, and whose creation process is described in Article 5 of the Terms and Conditions.

Members with an Account will benefit from more extensive services such as:

  • The possibility to apply for job offers, anonymous or not;
  • The possibility of receiving notifications of job offers targeted according to their profile;
  • The possibility of being recommended to Employers.

 

5. TL HUB ACCOUNT CREATION

5.1. Process

5.1.1. The User has the possibility to create an Account on the TL Hub Platform allowing him to become a Member.

5.1.2. The creation of an Account is free. However, the User is only authorized to create one Account which is strictly personal.

5.1.3. As part of the Account creation process, the User acknowledges having accepted TL Hub's Terms and Conditions and Privacy Policy by clicking on the specific box to that effect during registration. The Privacy Policy is available via the following link https://www.tl-hub.be/en/page/privacy.

5.1.4. The Member's Account will become fully effective once the request for Account Verification has been accepted by the User, and this within 48 hours of the request being sent to the e-mail address provided when the Account was created. Otherwise, the Account will not be created (Article 7.2.).

5.2. Other Services Related To The TL Hub Account

5.2.1. As specified in Article 4.1, Members have the possibility to apply for job offers, whether they are anonymous or not.

5.2.2. They have the possibility to fill in their Account profile with information related to their job search, to attach their CV or any document related to projects they have been involved in and that are relevant to their applications.

5.2.3. Members will also have a choice of available profiles: your profile may be 'available' or 'unavailable' depending on the visibility you wish to give it. You will be able to change the availability of your profile at any time.

5.2.4. TL Hub may also suggest your profile to Employers if it matches the description of the posted job.

5.2.5. For better visibility, TL Hub will also keep a history of applications within the Member's Account allowing him/her to trace the offers for which he/she has applied.

5.3. ACCOUNT OBLIGATIONS AND RESPONSIBILITIES

5.3.1. As specified in Article 5.12, the Account is strictly personal and is linked to the Member's profile only. Users and Members are prohibited from creating multiple accounts, creating false accounts using false identities, or creating accounts using identities that do not belong to them. In general, the use of another identity or a false identity is strictly prohibited.

5.3.2. Account access data is also strictly personal and confidential. The Member undertakes not to communicate them to third parties and not to make them public. The Member is responsible for their use and conservation.

5.3.3. In the event that access to your Account is compromised, in particular due to access by an unauthorized third party, you must immediately inform TL Hub and proceed to change your Account password in accordance with the procedure provided for this purpose.

5.3.4. Members agree to provide only relevant, up-to-date, and true information about their profile.

5.3.5. Members are responsible for the content they upload to the TL Hub Platform. Whenever Members upload attachments or content to the Platform, they shall ensure that they do not contain any virus or illegal content. The list is not exhaustive and the Member declares and acknowledges that the information transmitted to TL Hub will not contain the following elements:

  • Data relating to the national register of a natural person or special categories of data, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as genetic data, biometric data, data concerning health or data concerning a natural person’s sex life or sexual orientation;
  • Any content of an illegal, defamatory, or offensive nature that may infringe the rights of third parties or TL Hub and its subsidiaries;
  • Any content whose publication constitutes an offense under the legislation in force;
  • Any content that has no real connection to the application.

 

5.3.6. The transmission of the Member's personal information to third parties or to Employers is done under his sole responsibility.

6. LIABILITY AND EXCLUSION

6.1. TL Hub shall never be considered an Employer. Therefore, all decisions regarding the Member's employment will be the sole responsibility of the Employers, who are solely responsible for such decisions.

Thus, TL Hub can in no way guarantee the conclusion of an employment contract by the Member.

6.2. TL Hub guarantees the strict confidentiality of the information transmitted by the Members whenever they apply for an offer on the TL Hub Platform.

6.3. TL Hub takes all reasonable and necessary measures to ensure the proper functioning, security, and accessibility of its Platform. However, its use is always at the User's and Member's own risk. They acknowledge that they use it under their sole responsibility.

6.4. Due to certain technical or operational specificities, TL Hub cannot guarantee an unlimited amount of storage. Whenever necessary for the proper functioning of the TL Hub Platform, we reserve the right to temporarily or permanently limit the amount of data uploaded.

6.5. TL Hub takes care to ensure a secure and regular backup of its servers. Nevertheless, Members are solely responsible for the storage of their data transmitted on the Platform and ensure that they have made a backup of such data. TL Hub shall not be held responsible for any loss or deletion of data that may occur on their server.

6.6. TL Hub shall not be liable for any errors, omissions, accuracy, completeness, or lack of availability of the information contained on the TL Hub Platform. Furthermore, only the Employers are responsible for the content of the offers published on the TL Hub Platform.

TL Hub shall not be held responsible for any undesirable content that may appear on its Platform in case of illegal intrusion by a third party in TL Hub's computer system.

6.7. We shall not be held responsible for any direct or indirect damage resulting from access to the TL Hub Platform, for any temporary or permanent interruption or deletion of the Platform as well as of the services offered, for the occurrence of computer bugs or for any damage resulting from fraudulent intrusion of third parties from the TL Hub Platform.

6.8. It is the User's and Member's responsibility to protect themselves effectively from the dangers of the internet (viruses, malware, spyware, etc.), in particular to protect their data from malicious software. They are solely responsible for the means of access to the internet on the TL Hub Platform.

6.9. Users and Members are responsible for their proper use of the TL Hub Platform. They agree to avoid any process that may compromise the integrity and the interface of the TL Hub Platform. They also agree not to use any mechanism to capture data or to harm the TL Hub Platform by any means.

6.10. In general, Users and Members agree not to act illegally with respect to the legislation in force and not to harm TL Hub and its subsidiaries by any means whatsoever.

6.11. TL Hub reserves the right to take legal action and claim compensation for any damage caused by the Member or the User in case of violation of these Terms and Conditions or in case of infringement of its rights protected by the legal provisions in force.

7. INTELLECTUAL PROPERTY

7.1. SPECIFIC TO THE TL HUB PLATFORM

HR Web Management SRL owns the TL Hub Platform https://www.tlhub.be, operating under the trade name TL Hub by TRANSPORTMEDIA.

7.1.2. All structural and substantial components of the TL Hub Platform, including but not limited to texts, graphics, images, photographs, sounds and videos, databases, computer applications and the source code of the web pages, etc., are the exclusive property of TL Hub and are protected as such by the applicable legislation on intellectual property.

7.1.3. Any use, reproduction, representation, modification, translation, extraction, in whole or in part, of the content of the TL Hub Platform by any process whatsoever is strictly prohibited without the prior written consent of TL Hub.

7.1.4. Users and Members of the TL Hub Platform agree to respect the rights and prohibitions set forth above.

7.1.5. TL Hub as well as any other holder of these rights will be entitled to implement the measures or actions (judicial or not) necessary to stop the infringement of their intellectual property rights. We also reserve the right to claim damages for such infringement.

7.2. Member Specific

7.2.1. The Member is solely responsible for the content he/she uploads on the TL Hub Platform, including, but not limited to, plans, models, designs, or any work to which intellectual property rights may be attached.

7.2.2. TL Hub declines all responsibility for the rights attached to these contents. The Member guarantees that he/she is the owner of these rights or that he/she has the necessary authorizations for their use or publication.

7.2.3. The owners of these rights will be entitled to take any measures or actions (judicial or otherwise) necessary to stop the infringement of their intellectual property rights.

8. CANCELLATION

8.1. TL Hub reserves the right, in its sole discretion, to exercise all of its remedies, including, but not limited to, deletion of Member's Account in the event of Member's breach of these Terms and Conditions, or if TL Hub is unable to verify or authenticate the information Member provides to TL Hub.

8.2. As part of the Account creation process by the User, TL Hub reserves the right, at its sole discretion, not to give effect to the creation of the Account if it has not been verified by the User within 48 hours of sending the Account Verification request.

8.3. The Member may terminate his or her Account on the Platform at any time by following the procedure provided for this purpose.

9. HYPERLINKS

9.1. The TL Hub Platform may link to other sites or sources of information. These links or sources of information are made available to Users and Members for information purposes only. TL Hub does not control these sites and the information contained therein, and therefore we cannot be held responsible for the availability, content, advertising, and products offered by these sites, nor for the quality and/or completeness of this information.

9.2. TL Hub welcomes the creation of links to its Platform. However, prior authorization must be requested and obtained. You can send your request to the following address, and we will process your request as soon as possible:

9.3. TL Hub also reserves the right to require the removal of a link to its Platform if we believe that maintaining the link is not in line with our mission or for any other reason that we consider justified.

11. INTEGRITY OF THE CLAUSES

Notwithstanding the invalidity of any of the clauses of these General Terms and Conditions due to a change in legislation, regulations, or a court decision that has become final, the validity and compliance with the other clauses shall not be affected in any way.

12. JURISDICTION AND APPLICABLE LAW

12.1. These Terms and Conditions are governed by Belgian law.

12.2. Any dispute relating to the existence, interpretation, performance, or breach of the General Terms and Conditions concluded between the User, the Member, and TL Hub, even in case of multiple defendants, shall, in the absence of amicable agreement, be subject to the jurisdiction of the courts of the French-speaking judicial district of Brussels. This attribution of jurisdiction is valid notwithstanding the plurality of defendants or guarantee appeals, even for emergency procedures or protective procedures in summary proceedings or by petition.
